The invalidity of the constitutional rule for a doctoral thesis in the Faculty of Law
The Faculty of Law, University of Karbala, discussed the doctoral thesis tagged “The invalidity of the constitutional rule – a comparative study”, the thesis submitted by the student “Ali Subhi Omran”.
The thesis aimed to show that transgressing most constitutions goes beyond a basic and important principle is the extent to which the constitutional principles that these constitutions came with agree with international principles and agreements that are the official sources of constitutions, and transcends the internal and external customers of the country and transcends the constitutional precedents that constitutional law approaches, forgetting all of them to come out to us With a constitutional base that is invalid and contrary, it does not meet the aspirations of the people or the harmony of constitutional reality, and here the constitution has violated the accepted system of constitutional legality and has gone outside its scope, whether it is internal or external.
In conclusion, the study reached a number of results and recommendations, the most important of which is that constitutions bypassing the principle of the extent to which constitutional principles are in agreement with international principles and conventions results in consequences that are very difficult to avoid because these consequences will be based on a constitutional basis, and the constitution is the pyramid of laws, and here our need for constitutional invalidity emanates from In order to get rid of this legal spiral, and if nullity will face difficulty in avoiding it, it is not impossible. The state of invalidity includes degrees and ranks and contains images, types, effects, and influences that dominate the constitutional base in order for the truth to emerge in it.
